1. Introduction

Welcome to HushMeadowLane ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your utilisation of our yacht charter solutions and the website situated at hushmeadowlane.sbs (the "Service") operated by HushMeadowLane.

Booking a charter or utilising our Service implies your acceptance of these Terms. Should you not concur with any section of these terms, you are then restricted from accessing the Service.

2. Service Overview

HushMeadowLane offers superior yacht charter services that include, but are not limited to:

• Daily yacht hires
• Sunset tours
• Company getaways
• Private gatherings
• Extended charters

Availability of all services is dependent on conditions and we may change or terminate services as seen fit.

3. Booking and Reservations

3.1 Booking Procedure

In order to place a booking, you must:

• Be no less than 18 years old
• Submit accurate and full details
• Remit the necessary deposit as outlined in your booking acknowledgement
• Consent to these Terms & Conditions

3.2 Confirmation

A booking is deemed confirmed only once payment is made and our written acceptance is issued. Service to any individual may be denied at our discretion.

3.3 Availability

Charter availability is contingent on vessel readiness and suitable climatic conditions. We will strive to fulfil your preferred scheduling.

4. Payment Terms

4.1 Prices

Quotations of all fees are made in € and are inclusive of taxes unless stated differently. Prices may be subject to alteration without prior notice.

4.2 Payment Timetable

• Initial payment: 50% of the total cost of the charter is due upon booking
• Remaining amount: Payable 48 hours before the departure of the charter
• Additional fees (when applicable): Settled after the charter concludes

4.3 Methods of Payment

We accept major credit cards, electronic funds transfers, and certified cheques. Payments are processed securely with encryption.

5. Cancellation and Refund Policy

5.1 Cancellations by Clients

• 72+ hours prior to departure: Complete refund minus processing fees
• 24-72 hours before departure: Refund of 50%
• Less than 24 hours before departure: No reimbursement

5.2 Weather-Related Cancellations

If the captain deems weather conditions unsafe, we will suggest:

• Rebooking for the next open date without additional cost
• A full refund if rescheduling is unfeasible

5.3 Mechanical Failures

If mechanical issues arise with the vessel designated for your charter, we will endeavor to deploy a substitute. Absent a replacement, a full reimbursement will be rendered.

6. Safety and Conduct

6.1 Safety Regulations

All patrons must:

• Adhere to all directives from the crew
• Wear necessary safety gear as instructed
• Disclose medical conditions affecting their safety
• Stay within designated sections of the vessel

6.2 Restricted Items

Certain items are forbidden on the vessel:

• Containers made of glass
• Illegal substances
• Firearms or other weapons
• Pets (without prior approval)

6.3 Behaviour

Passengers should behave respectfully at all times. In the event of misconduct posing safety threats or spoiling the experience for other passengers, we retain the right to conclude the charter prematurely without reimbursement.

7. Liability and Insurance

7.1 Our Responsibility

We are only liable up to the charter fee you paid. We shall not be accountable for:

• Personal harm resulting from guest recklessness
• Theft or destruction of personal items
• Indirect or consequential losses or punitive damages
• Delays arising from atmospheric conditions or events beyond our control

7.2 Insurance

Our vessels and operations are covered under comprehensive marine insurance. You are advised to arrange your own travel and personal insurance.

7.3 Risk Acceptance

Participation in our charters means you comprehend the inherent risks of maritime activities and accept personal responsibility for your safety and security.

8. Changes to Itineraries and Schedules

We reserve the right to alter itineraries, routes, or schedules in the interest of safety, weather, or operational necessities. Efforts will be made to offer comparable alternative experiences.

9. Uncontrollable Circumstances

We are not liable for interruptions, terminations, or service changes caused by events outside our authority, including but not limited to:

• Harsh meteorological conditions
• Natural disasters
• Regulatory acts
• Port shutdowns
• Equipment breakdowns

10. Privacy and Data Security

Your personal data is handled according to our Privacy Policy. By engaging with our services, you agree to the gathering and use of your information as outlined in said policy.

11. Proprietary Rights

All material on our website, such as text, graphics, logos, and images, is protected by intellectual property laws. Unauthorized replication, distribution, or creation of derivative works is prohibited unless specifically permitted in writing by us.

12. Jurisdiction

These Terms are subject to the laws of Monaco. Any disputes will be resolved in the legal courts situated in Monte Carlo, Monaco.
